What the client told us:

My name is Joe Client, and my wife Betty and I live in a subdivision outside Lafayette, Louisiana. We’ve got two kids and a dog, and we wanted to put up a six-foot privacy fence around our backyard for safety and some privacy.

Our HOA covenants say fences need architectural approval, so we did it by the book. We submitted a written request with a drawing, the material (wood), and the color. The Architectural Committee denied us without any clear explanation, just saying it was “not in harmony with the neighborhood.”

Several neighbors already have similar fences – some are taller and in worse shape than what we proposed. When we pointed that out, the board said those were “grandfathered” and then threatened us with fines and even a lien if we put up the fence anyway.

It feels like the rules are being applied selectively. The board won’t give us anything detailed in writing beyond short denial letters. We don’t want to hurt our property value or get into a legal mess, but we also don’t want to just roll over. We want to know our real options under Louisiana law, whether we can challenge this denial, and we’d like help drafting letters or taking the next step if this escalates.
